Frequently Asked Questions regarding the EasyTone FTC Settlement

1. Why did Reebok settle with the FTC as opposed to litigating?
Reebok made a business decision to settle with the FTC in order to avoid protracted litigation and to move our focus back to where it belongs: to our customers. Settling does not mean we agreed with the FTC's allegations; we do not.

2. Does the FTC settlement cover all Reebok products in the toning category, including footwear and apparel – or footwear only?
The FTC lawsuit covers Reebok’s EasyTone, RunTone, SimplyTone, TrainTone and JumpTone footwear and EasyTone Apparel.

3. Can I get a refund for my toning category footwear and/or apparel?
Consumer redress will be handled by completing an FTC claim form which is available at www.ftc.gov/reebok.

4. Is Reebok and/or its retailers going to tell all consumers who purchased the Reebok toning products about the FTC settlement?
The settlement with the FTC is available on the FTC’s website at www.ftc.gov/reebok.

5. The FTC alleges that Reebok’s advertising for some of its footwear and apparel in the toning category was unsubstantiated, and the testing did not support the claims. What testing was done?
For our testing, Reebok tested in labs and on consumers. Reebok conducted sway tests, pressure tests, EMG tests and wear tests. Reebok continues to invest in testing of its products in the toning category. We currently have two separate studies underway to test our EasyTone footwear and apparel.

6. What do you think Reebok’s new studies will show?
It is too soon to tell what the new studies will show.

7. How did the FTC pick $25 million? Is that the amount of toning product sales?
$25 million was the number that the FTC and Reebok settled on after negotiating. $25 million does not bear a direct correlation to Reebok’s product sales in the toning category.

8. Does Reebok have to stop selling products in the toning category?
Reebok does not have to stop selling products in the toning category. We have agreed to make changes to our advertising claims, but otherwise will continue with business as usual.

9. Will the Reebok toning category products themselves be altered in any way as a result of the settlement?
We have no plans to alter our products.

10. Does Reebok need to now pull advertising / marketing materials?
Reebok and its retailers will remove all marketing materials that refer to muscle toning, muscle strengthening, muscle activation, quantified percentage claims, and improvements in posture. We will continue to support EasyTone footwear and apparel with new advertising and marketing materials.
